2. The Business Model of a Legal Clinic
Management should assess the most
favorable factors, and identify the least
favorable factors, related to proposals for
Walk-in/Appointment Systems and Legal
Clinic Program Evaluations such as Goal-
based, Process or Outcomes. Further
assistance on how to establish a U.S. non-
profit is provided by the free guidelines
set out at NCNA.org
The Business Model Canvas shows charity
leaders and board members that their
entity is capable of operating a legal
clinic. The sketched Canvas clearly
demonstrates to funders and grant
providers that the starting/evolving
program is professional and worthy of
funding. The Canvas can also be used to
develop and refine the legal clinic’s
business model.
3. The 9 building blocks of the Business Model Canvas
1) Key partners, such as providers/suppliers from whom the
organization sources key resources, or partners with
whom the organization collaborates.
2) Key activities, required to deliver the organization
services, such as the channels, client relationships, and
revenue streams.
3) Key resources, describing what resources the
organization needs to undertake key activities, such as
presenting its value proposition and maintaining client
relationships.
4) Value proposition, problems that the organization solves
for its clients, what client needs are satisfied.
5) Client relationships, what kinds of relationships should
the organization maintain with different types of clients,
and what do these cost?
6) Channels, what is the best way to reach each client
segment?
7) Client segments, the most valuable clients to the
organization.
8) Cost structure, what are the most important costs, which
resources and activities are most expensive?
9) Revenue streams, what will clients pay for? What do they
currently pay and to whom?
The Business Model Canvas was co-
created by Dr Osterwalder, world
renowned entrepreneur and co-author
of an international bestseller which sold
over 1 million copies in 30 different
languages. The Canvas is used now by
leading organizations around the world,
like GE, P&G, Ericsson, NASA, PWC, intel
and 3M. Dr Osterwalder, states that a
business model can best be described
through nine basic building blocks that
show the logic of how a company/
organization intends to secure revenues.
The nine building blocks assist the legal
clinic to adapt/survive on nominal fees
and donations:
4. Client Segments for the Immigration Legal Clinic
Undocumented immigrants are a
common client segment for a legal clinic.
In USA, some paths to Legal Status for
undocumented immigrants include:
• Deferred Action for Childhood Arrivals (DACA)
• Green Card through Marriage to a U.S. Citizen or
Lawful Permanent Resident (LPR)
• DREAMers Green Card through Employment with
LIFE Act Protection
• Asylum Status
• U Visa for Victims of Crime
• Undocumented immigrants who entered USA
before 1972, and resided here continuously since
then, may be eligible for lawful status under the
little-known Registry legalization program.
It is essential to have a clear
understanding of the client segments for
the immigration legal clinic. The following
census reports will assist you to estimate,
by particular region, the number of non-
citizens and undocumented:
• U.S. Bureau of Census American Fact Finder;
• The Center for Applied Research in the Apostolate
(CARA) at Georgetown University;
• The Pew Hispanic Center;
• The Migration Policy Institute;
• Grantmakers Concerned about Immigrants and
Refugees (GCIR);
• The Department of Homeland Security (DHS)
Statistical Yearbook; and
• In relation to U-visas, State and local police
departments and district attorneys maintain
useful crime statistics.
5. The demand for Immigration Legal Clinics in USA
Further motivation for immediate action
stemmed from the possibility of the
Deferred Action for Parents of Americans
(DAPA) Initiative being enacted in June
2016. Such action would mean that 3.7
million (MPI estimate)
undocumented/illegal immigrants could
apply for legal residency in the U.S. In
addition to DAPA's enactment, there was
the added probability of expanding the
eligibility requirements of the current
Deferred Action for Childhood Arrivals
(DACA). This could have increased the
eligibility by about 330,000 immigrants.
This is according to the Pew Research
Center. These developments would result
in the requirement to provide pro-
bono/low-cost immigration legal services
for an additional 4 million people in
future years.
In 2015, more U.S. charities began
researching how to start their own
Immigration Legal Clinic. However, some
have difficulty in understanding the
process of setting up these pro
bono/low-cost legal services. A large
number of them are motivated to
facilitate the many thousands of Cuban
refugees rushing to the U.S. borders to
obtain permanent residency. They fear
imminent ending of the Cuban
Adjustment Act of 1966. Moreover, there
is still an ongoing demand for pro-bono
immigration law expertise. This is to help
the many thousands of Latin American
children who recently transgressed
across the Texas border seeking asylum
in the U.S.
