You have to notify the health plan administrator within 60 days of a divorce or legal separation to continue under COBRA. What do I do when my former company does not offer me COBRA? The health plan administrator has 14 days to send you the denial letter. If you qualify, they have 44 days to send you the enrollment paperwork. If they don't, send them a demand letter. Then you can complain to the DOL and IRS. My employer has less than 20 employees. Do they have to offer me COBRA? Only AL, AK & DE do not have a COBRA like statute. Unless you live in those states, you most likely are owed a COBRA notice by the group health plan administrator or insurance company. If my employer goes bankrupt, what will happen to my COBRA rights? The BK is not really the issue, except in how it effects the health plan. If the group insurance ends, COBRA ends. My employer rejected my request for COBRA. What should I do now? If I have pre existing conditions, should I wait until I get into another group plan? It depends how long you have to wait and what level of care you need. If you have to wait over 62 days until your new insurance starts, enroll in COBRA.
