    • WAIVER AND RELEASE FOR SOFTBALL These camps are hosted, organized, and administrated by EVANGEL UNIVERSITY members of the coaching staff at Evangel University (Please Sign) 2011 EVANGEL SOFTBALL CAMPSI, , on behalf of(hereinafter referred to as “CHILD”) HEREBY WAIVE AND RELEASE, indemnify, hold harmless andforever discharge EVANGEL UNIVERSITY and its agents, employees, officers, directors, affiliates, Springfield, Missouri 65802 1111 N. Glenstone Ave EVANGEL UNIVERSITY SOFTBALL CAMPS Donovan Nelson—Summer Camps Directorsuccessors and assigns, of and from any and all claims, demands, debts, contracts, expenses, causes ofaction, lawsuits, damages and liabilities, of every kind and nature, whether known or unknown, in law orequity, that I or CHILD ever had or may have, arising from or in any way related to CHILD’S participationin any of the events or activities conducted by, on the premises of, or for the benefit of EVANGELUNIVERSITY SOFTBALL CAMPS provided that this waiver of liability does not apply to any acts of grossnegligence, or intentional, willful or wanton misconduct.I understand that the activities that said CHILD will participate in are inherently dangerous and may causeserious or grievous injuries, including bodily injury, damage to personal property and/or death. On behalfof myself, CHILD, my heirs, assigns and next of kin, I and said CHILD waive all claims for damages,injuries and death sustained to me or my property, that I or said CHILD may have against the aforemen-tioned released party to such activity.CHILD has the necessary and requisite skills to participate in all facets of, and activities of and requestedof this facility, except as noted below. The nature of the activities has been fully disclosed and any flyer, CRUSADER SOFTBALLadvertisement, or brochure relating to the participating activities is expressly made a part of this WAIVERAND RELEASE.By this Waiver, I, on behalf of said CHILD, assume any risk, and take full responsibility and waive anyclaims of personal injury, death or damage to personal property associated with EVANGEL UNIVERSITY 2011 CAMPSSOFTBALL CAMPS, including but not limited to training at the facility, using the facility/field/stadium andits equipment, practicing and/or engaging in any softball drills, exercises, leagues, or activities, events orother related activities on and off the premises. Advanced Hitting CampThis WAIVER AND RELEASE contains the entire agreement between the parties, and super cedes anyprior written or oral agreements between them concerning the subject matter of this WAIVER AND June 2 ◊ 5—8 PM ◊ Grades 9—12 ◊ $60RELEASE. The provisions of this WAIVER AND RELEASE may be waived, altered, amended orrepealed, in whole or in part, only upon the prior written consent of all parties. Instructional Hitting CampThe provision of this WAIVER AND RELEASE will continue in full force and effect even after the termina-tion of the activities conducted by, on the premises of, or for the benefit of, EVANGEL UNIVERSITY June 9 ◊ 8—12 pm ◊ Grades 5—12 ◊ $75SOFTBALL CAMPS whether by agreement, by operation of law, or otherwise.I have read, understand and fully agree to the terms of this WAIVER AND RELEASE. I understand and Instructional Pitching Campconfirm that by signing this WAIVER AND RELEASE said CHILD and I have given up considerable future June 9 ◊ 1—5 pm ◊ Grades 5—12 ◊ $75legal rights. I have signed this Agreement freely, voluntarily, under no duress or threat of duress, withoutinducement, promise or guarantee being communicated to me. The policy providesexcess coverage for students with other insurance coverage, but it pays only when other benefits have July 19 ◊ 8—12 pm ◊ Grades 2—6 ◊ $45been exhausted. In cases in which a student has no other coverage with either a commercial insuranceagency, Medicare, or Medicaid, the EVANGEL UNIVERSITY CAMP insurance policy is the primarypolicy, but it will only cover the participant according to the terms of the insurance.
