SchreierSDRC, INC., et al., ) ) Defendants/Counterclaim-Plaintiffs, ) ) )SDRC, INC., et al., ) ) Third-Party Plaintiffs, ) ) v. ) )HENRY ZOU, et al. ) ) Third-Party Defendants. ) JOINT MOTION TO VOLUNTARILY DISMISS, WITHOUT PREJUDICE, ALL CLAIMS, COUNTERCLAIMS, AND THIRD-PARTY CLAIMS Plaintiffs/Counterclaim-Defendants Zhang Yongjun, Yan Jingqi, Zheng Caiwen, andWang Xinping (collectively, the “Investors”), Defendants/Counterclaim-Plaintiffs/Third-PartyPlaintiffs SDRC, Inc., SD Investment Fund LLC 6, and Joop Bollen (collectively, the “SDRCDefendants”), and Henry Tongzhao USA Consulting, Inc., through their respective undersignedattorneys, and pursuant to Rule 41 of the Federal Rules of Civil Procedure, respectfully requestthat this Court grant this Motion and dismiss all claims, counterclaims, and third-party claimswithout prejudice, with all parties agreeing to bear their own attorneys’ fees and costs. Insupport of this Motion the Parties state as follows:
  • 2. Case 4:11-cv-04148-KES Document 54 Filed 03/27/12 Page 2 of 5 PageID #: 907 1. This lawsuit was initially filed on October 18, 2011 by four individuals who areno longer parties. See Doc. 1. On November 7, 2011, an Amended Complaint was filed thatadded the Investors as parties. See Doc. 17. 2. On January 5, 2012, the SDRC Defendants filed an Answer and Counterclaims tothe Amended Complaint. See Doc. 26. Shortly thereafter, the SDRC Defendants also filed aThird-Party Complaint against Third-Party Defendants Henry Zou and Henry Global ConsultingGroup a/k/a Henry Global a/k/a Henry Global Group a/k/a Henry Global Consulting USA(collectively, “Henry Group”). See Doc. 29. An Amended Counterclaim was subsequently filed.See Doc. 35. 3. On February 15, 2012, the Investors moved to dismiss the AmendedCounterclaims. See Docs. 36-37. And on February 22, 2012, Henry Tongzhao USA Consulting,Inc. appeared and moved to dismiss the Third-Party Complaint. See Docs. 43-45. 4. Those Motions to Dismiss are still in the process of being briefed. 5. The Parties have now agreed to dismiss all claims in this litigation withoutprejudice, including the claims in the Amended Complaint, the Amended Counterclaims, and theThird-Party Complaint. See Fed. R. Civ. P. 41(a)(2) (Amended Complaint); 41(c)(1) (AmendedCounterclaims and Third-Party Complaint).

Granting this Motion; 2. Dismissing all claims in the Amended Complaint, Amended Counterclaims, andThird-Party Complaint without prejudice, with all parties to bear their own costs and fees; and 3. Terminating this case in its entirety.
