             Mexico

Growing awareness of the financial value of brand protection has fuelled an increase in the volume of trademark filings in
Mexico over the past year. This has coincided with a period of considerable change to the legal landscape, with a new
president elected and the country paving the way for Madrid accession. The short and long-term implications of this latter
development are thus far uncertain: while some commentators are adopting a cautious ‘wait-and-see’ stance, others have
taken heart from the example of the United States, which saw few ill effects post-accession. Experts are largely in agreement
on the need to introduce opposition procedures – currently a notable absence in this jurisdiction – alongside the protocol.
Anti-counterfeiting procedures have been streamlined by customs authorities, which are keen to improve communications
both across government departments and with lawyers. The closer cooperation which has ensued allows swifter action to be
taken against fakes entering the marketplace.

          GOLD Firms

companies. Its admirable set of lawyers includes Martin Michaus, who wins accolades Legarreta Y Asociados SC

This IP boutique continues to grow in stature and excels across the board, although
searches and registrations are a cornerstone of its offering, thanks in part to an
advanced internal database. The pioneering team has blazed a trail in 3D mark
registration, recently prevailing in a ground-breaking case for a domestic client. The firm also has a busy anti-counterfeiting practice, and
has the necessary strength and depth to maintain a standalone team in this area. The wisdom of senior partner Sergio Olivares is highly
prized. His “persuasive and thorough” prosecution places him on a par with Mexico’s best, and his commanding courtroom performances
also garner plaudits. “Exceptional on both contentious and non-contentious matters”, Antonio Belaunzaran Martinez plays an integral
part in the firm’s continued success.

Rankings 2013 wtr 1000 - world trademark review (2)

  • 1. Mexico - Rankings - WTR 1000 - World Trademark Review http://www.worldtrademarkreview.com/wtr1000/rankings/DetailV2.aspx?... 3 2 1 Mexico Growing awareness of the financial value of brand protection has fuelled an increase in the volume of trademark filings in Mexico over the past year. This has coincided with a period of considerable change to the legal landscape, with a new president elected and the country paving the way for Madrid accession. The short and long-term implications of this latter development are thus far uncertain: while some commentators are adopting a cautious ‘wait-and-see’ stance, others have taken heart from the example of the United States, which saw few ill effects post-accession. Experts are largely in agreement on the need to introduce opposition procedures – currently a notable absence in this jurisdiction – alongside the protocol. Anti-counterfeiting procedures have been streamlined by customs authorities, which are keen to improve communications both across government departments and with lawyers. The closer cooperation which has ensued allows swifter action to be taken against fakes entering the marketplace.
