What happened <ul><li>He plays 5-a-side football every Monday night </li></ul><ul><li>One night a bench was left out, he did notice but didn’t do anything </li></ul><ul><li>20 minutes into the match he ran straight into the bench, and fell badly </li></ul><ul><li>He spent the rest of the evening in casualty, he had: </li></ul><ul><li>Small cut above his eye -shin was heavily bruised </li></ul><ul><li>right arm was broken </li></ul>

Mark’s Losses <ul><li>Loss of earnings: 4 weeks at £450 a week £1,800.00. </li></ul><ul><li>Replacing glasses, damaged in the accident - £100.00 </li></ul><ul><li>Taxi fares, when unable to drive at £40.00. </li></ul><ul><li>He had 2 tickets to a music festival costing £100 each – he wasn’t able to drive, so the tickets were not used. </li></ul><ul><li>Pain and suffering from broken arm, a badly bruised shin, minor bruising to the head. (£3,500 - £9,500) </li></ul>

Mark’s Solicitor’s Argument <ul><li>Local authority should have made sure the room was safe </li></ul><ul><li>Leisure centre staff had a responsibility to make sure that the sports hall was safe </li></ul><ul><li>They failed in this responsibility by not putting the bench away </li></ul><ul><li>This caused Mark’s injury </li></ul>
  5. 5. Local Authorities Argument <ul><li>Mark saw the bench and didn’t move it or told anyone it was left out </li></ul><ul><li>There for he contributed to the accident </li></ul><ul><li>So the damages should be reduced, also know as ‘contributory negligence’ </li></ul>

My Opinion <ul><li>I think Mark should get a reduced amount of money because he did see the bench and didn’t move it </li></ul><ul><li>He should get money for </li></ul><ul><ul><li>any medical treatment he needs (?) </li></ul></ul><ul><ul><li>the money he has missed out on as he hasn’t been able to go to work (£1,800.00) </li></ul></ul><ul><ul><li>Money he used to replace his glasses (£100) </li></ul></ul><ul><ul><li>Taxi fares (£40) </li></ul></ul>
