The Spanish Bar requests the immediate release
of the ICC lawyer Esteban Peralta
• The University Professor is one of the four staff members of the
International Criminal Court (ICC) arrested in Libya
• The CGAE expresses its concern to the Spanish Government and the
European Institutions and supports the diplomatic action carried out to
achieve his freedom.
11/06/2012.- The Spanish Bar (CGAE) would like to voice its concern for the detention
of the Member of the International Criminal Court (ICC) Esteban Peralta, arrested on
Thursday along with three members of the Court in the town of Zintan.
At the same time, the CGAE has expressed its support and readiness to cooperate to
the Minister José Manuel García-Margallo in all diplomatic efforts in order to achieve
his immediate release.
Peralta is Head of Legal Support Section at the ICC since 2003 and has a close
relationship with the Spanish legal profession as well as with the Council of European
Bars and Law Societies (CCBE). Born in Zaragoza, he is also a University teacher of
Public International Law at its hometown University.
The ICC delegation, formed by Peralta and other three staff members of the Court,
arrived in Libya on Wednesday to visit Saif al Islam Gadhafi, son of Moammar al
Gadhafi, claimed by the ICC and accused of crimes against humanity.
The International Court has pointed out that the delegation mission had the
authorization of the Libyan authorities and has diplomatic immunity, as it was in an
official mission of the ICC. Indeed, the High international Court has the duty to ensure
that suspects or accused persons know their right to have a fair trial and access to
lawyer of their choice, as well as that they are treated humanely, as clarified by ICC.
The Spanish Bar also adheres to the statements public press releases made by the
International Criminal Court and International Criminal Bar that stresses, “the crucial
